AGB Allgemeine Geschäftsbedingungen

Geltungsbereich der AGB

Die Kitchener AG (in der Folge „KITCHENER“) erbringt sämtliche Lieferungen und Leistungen auf der Basis der vorliegenden AGB. Die AGB gelten für sämtliche in unserem E-Shop getätigten Bestellungen, nicht aber für Bestellungen und Einkäufe in unseren Verkaufslokalen.

1. Angebot und Vertragsabschluss

Unsere Preise sind in Schweizer Franken (CHF) angegeben und enthalten die gesetzliche schweizerische Mehrwertsteuer von 8.0%. Für Kunden resp. Lieferungen mit Zielort ausserhalb der Schweiz reduzieren sich die angegebenen Preise um 8.0 Prozentpunkte. Die Versandkosten sind in den Preisen nicht enthalten. Falls Versandkosten belastet werden, sind diese bei Bestellungsabschluss (Schritt „Bestellungsübersicht) separat ausgewiesen (vgl. 3. Versandkosten).

Unser E-Shop-Sortiment wird laufend aktualisiert. Dennoch besteht die Möglichkeit, dass Artikel, obschon im E-Shop enthalten, nicht mehr lieferbar sind. Ist ein Artikel nicht mehr lieferbar, wird der Kunde per E-Mail informiert. Allfällige Restbestellungen behalten ihre Gültigkeit.

Der Kaufvertrag kommt mit Annahme der Bestellung durch KITCHENER zustande.

2. Bestellung und Zahlung

Bestellungen können nur über das Online-Bestellsystem unseres E-Shops aufgegeben werden. Bestellungen via Telefon, Fax oder E-Mail können nicht berücksichtigt werden.

KITCHENER akzeptiert folgende Zahlungsmittel: Visa, MasterCard, PayPal, Maestro, Postcard

3. Versandkosten

Die Versandkosten für Post Pac Priority ( A -Post ) & B- Post Bestellungen und/oder Zielort ausserhalb der Schweiz werden pro Bestellung individuell berechnet. Sie sind abhängig vom Bestellungsumfang und dem Zielort der Bestellung. Die Versandkosten werden bei Abschluss der Bestellung (Schritt „Bestellungsübersicht“) ausgewiesen und dem Kunden belastet.

Sendungen mit Zielort ausserhalb der Schweiz können mit Zoll- und Mehrwertsteuerkosten des Bestimmungslands belastet werden. Auf diese Kosten hat KITCHENER keinen Einfluss. Diese Kosten trägt der Kunde.

4. Lieferfristen

Es gelten in der Regel die folgenden Lieferfristen:

Schweiz
B – Post ca 4- 5 Werktage ab Bestellungseingang
Post Pac Priority ( A -Post ) ca 1-3 Werktage ab Bestellungseingang

Pick up in Bern oder Zürich je nach Lagerbestand 1 – 2 Tage.

Europa
7 - 21 Werktage ab Bestellungseingang

Aussereuropäisches Ausland
10 – 30 Werktage

Diese Angaben sind ohne Gewähr.
Es ist in Ausnahmefällen möglich, dass die genannten Fristen überschritten werden.

5. Eigentumsvorbehalt

Die Ware bleibt bis zur vollständigen Bezahlung Eigentum von KITCHENER.

6. Rückgaberecht

Im KITCHENER E-Shop bestellte Artikel können grundsätzlich innert 10 Tagen ab Erhalt retourniert werden. KITCHENER erstattet bereits geleistete Zahlungen erst nach Rückerhalt der Ware. Rückerstattungen sind nur dann möglich, wenn die Ware in einwandfreiem, neuwertigem Zustand bei uns eintrifft. Versiegelte Artikel (z. B. Bücher) können nur originalverpackt und ungeöffnet retourniert werden. Die Kosten für Rücksendungen an KITCHENER trägt der Kunde.

Mangelhafte Artikel können, sofern der Mangel nicht auf schuldhaftes Verhalten des Kunden zurückzuführen ist, innert zehn Tagen ab Erhalt retourniert werden. Artikel mit versteckten Mängeln können innert zehn Tagen ab Auftreten der Mängel retourniert werden. Eine Erstattung der Rücksendekosten an den Kunden ist in diesen Fällen vorgesehen, jedoch muss KITCHENER vorgängig kontaktiert und die Versandart vereinbart werden.

7. Haftung

KITCHENER übernimmt keine Haftung für allfällige Schäden, die durch die Benutzung der gekauften Produkte, insbesondere bei unsachgemässem Gebrauch, entstehen.

8. Datenschutz / Sicherheit

KITCHENER speichert nur die für die Geschäftsabwicklung notwendigen Kundendaten und benutzt diese ausschliesslich zu diesem Zweck. Sämtliche Kundendaten werden entsprechend der Datenschutzgesetzgebung vertraulich behandelt. KITCHENER gibt keine Daten an Dritte weiter. Sämtliche Daten werden via https gesichert übermittelt (SSL-Verschlüsselung).

9. Gerichtsstand

Unsere Geschäftstätigkeit basiert ausschliesslich auf schweizerischem Recht. Gerichtsstand ist Bern.

10. Allgemein

Mit Übermittlung einer Bestellung an KITCHENER bestätigt der Kunde, die allgemeinen Geschäftsbedingungen gelesen, verstanden und akzeptiert zu haben.

general terms and conditions

Scope of application of the GTC

Kitchener AG (hereinafter referred to as "KITCHENER") shall provide all deliveries and services on the basis of these GTC. The General Terms and Conditions apply to all orders placed in our e-shop, but not to orders and purchases in our sales premises.

1. Offer and conclusion of contract

Our prices are quoted in Swiss francs (CHF) and include the statutory Swiss value added tax of 8.0%. For customers or deliveries to destinations outside Switzerland, the indicated prices are reduced by 8.0 percentage points. Shipping costs are not included in the prices. If shipping costs are charged, they are shown separately when the order is placed (step "Order overview") (see 3. Shipping costs).

Our e-shop assortment is constantly updated. Nevertheless, there is the possibility that articles, although contained in the e-shop, are no longer available. If an article is no longer available, the customer will be informed by e-mail. Any remaining orders remain valid.

The purchase contract is concluded with the acceptance of the order by KITCHENER.

2. Order and payment

Orders can only be placed via the online ordering system of our e-shop. Orders placed by telephone, fax or e-mail cannot be considered.

KITCHENER accepts the following payment methods: Visa, MasterCard, PayPal, Maestro, Postcard

3. Shipping costs

The shipping costs for Post Pac Priority orders ( A -Post ) and B-Post Ordersand /or destinations outside Switzerland are calculated individually per order. They depend on the size of the order and the destination of the order. The shipping costs are shown on completion of the order (step "order overview") and charged to the customer.

Shipments to destinations outside Switzerland may be subject to customs and value-added tax in the country of destination. KITCHENER has no influence on these costs. These costs shall be borne by the customer.

4. Delivery periods

As a rule, the following delivery periods apply:

B – Post/ Economy Post: approx. 4- 5 working days from receipt of order
Post Pac Priority ( A-Post ): approx. 1-3 working days from receipt of order

Pick up in Bern or Zurich depending on stock 1 - 2 days.

Europe
7 - 21 working days from receipt of order

Non-European countries
10 - 30 working days

This information is without guarantee.
In exceptional cases, it is possible that the deadlines stated may be exceeded.

5. Retention of title

The goods remain the property of KITCHENER until full payment has been received.

6. Right of return

tems ordered in the KITCHENER E-Shop can be returned within 10 days of receipt. KITCHENER will refund payments already made only after receipt of the goods. Refunds are only possible if the goods arrive in perfect, mint condition. Sealed articles (e.g. books) can only be returned in their original packaging and unopened. The costs for returns to KITCHENER shall be borne by the customer.

Defective articles can be returned within 10 days of receipt, provided that the defect is not attributable to culpable conduct on the part of the customer. Articles with hidden defects can be returned within 10 days of the occurrence of the defects. A refund of the return costs to the customer is provided for in these cases, but KITCHENER must be contacted in advance and the shipping method agreed.

7. Liability

KITCHENER shall not be liable for any damages resulting from the use of the products purchased, in particular for improper use.

8. Data protection / security

KITCHENER stores only the customer data necessary for the business transaction and uses these exclusively for this purpose. All customer data will be treated confidentially in accordance with data protection legislation. KITCHENER does not pass on any data to third parties. All data is transmitted securely via https (SSL encryption).

9. Place of jurisdiction

Our business activities are based exclusively on Swiss law. Place of jurisdiction is Bern.

10. General

By submitting an order to KITCHENER, the customer confirms that he has read, understood and accepted the general terms and conditions.
